By downloading, installing, or using Master Valley ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Master Valley.
Master Valley is an AI-powered art history education and photo transformation application. The App allows users to transform their photos into various art historical styles using artificial intelligence technology. The App also provides educational content about art movements, master artists, and East Asian art traditions.
You must be at least 18 years of age to create an account and use this App. By using the App, you represent and warrant that you are 18 years of age or older. If you upload a photo containing a minor, you must be the parent or legal guardian of that minor, or have obtained explicit consent from their parent or legal guardian. The App automatically applies enhanced safety measures to photos detected as containing minors, designed to promote age-appropriate processing.
You may create an account using Google Sign-In, Apple Sign-In, or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
By using the App's photo transformation feature, you expressly consent to the following: Your uploaded photo will be transmitted to third-party AI services solely for the purpose of generating your art-style transformation and related features. These services currently include Replicate (AI image generation via the FLUX model), Anthropic (photo analysis and art style matching), Google (image editing via the Gemini model for modification requests), and OpenAI (GPT-4o for master artist dialogue and vision-based commentary on transformed images). These third-party services process your photo data in real time. We do not intentionally retain your photos beyond the time necessary for real-time processing; however, transient caching may occur for technical or security purposes. Third-party retention is governed by each provider's own data retention policies. No facial geometry, biometric identifiers, or biometric information is extracted, collected, or stored by Master Valley or its third-party service providers for any purpose other than generating your requested transformation. Your photo data is not used to train AI models, build facial recognition databases, or create biometric profiles. We may change AI service providers from time to time; the then-current list is maintained in our Privacy Policy.
When our AI system detects that a photo contains a minor, additional safety measures are automatically applied, designed to minimize the risk of sexually suggestive, nude, or age-inappropriate content being generated. However, no AI system can guarantee absolute prevention in all cases. These protections operate at the prompt level and are applied regardless of the selected art style.
The App operates on a cash-based system. Cash can be purchased through in-app purchases and is used to perform photo transformations. All cash purchases are final and non-refundable, except as required by applicable law or the policies of the Apple App Store or Google Play Store. Cash does not expire. Pricing is displayed within the App prior to purchase. For One-Click bundle products, the full price is charged when at least one transformation in the bundle succeeds; items that fail can be retried within the App at no additional cost.
The App uses artificial intelligence to transform photos into art historical styles. You acknowledge and agree that:
AI transformation results are inherently unpredictable. The output may not always match your expectations, and results may vary depending on the input photo, selected style, and other factors.
The App matches your photo to masterwork compositions from art history. As classical masterpieces may contain artistic nudity as part of their original composition, transformation results may reflect such elements. This is a characteristic of the art historical source material, not an intentional feature of the App.
While we employ multiple safeguards to minimize unintended content—including detection, content restriction, prompt-level safeguards, and content moderation—no AI system can guarantee perfectly predictable results in every case. You assume the risk of receiving unexpected or unintended transformation results.
For photos containing minors, enhanced content protection is automatically applied. The App's AI system applies strict safeguards designed to prevent the generation of sexual, nude, or otherwise inappropriate content involving minors; however, no system can guarantee absolute prevention in all cases. You are prohibited from sharing or distributing any transformation result containing artistic nudity to minors.
For the purposes of safety enforcement, all individuals reasonably identified as under 18, including teens, are treated as minors and subject to the strictest content protection standards.
You acknowledge that AI-generated outputs may occasionally produce unintended results. You assume full responsibility for reviewing and deciding how to use any generated content.
All transformation results are AI-generated and are presented as such within the App.
You retain all rights to the photos you upload to the App. By using the App, you grant us a limited, non-exclusive license to process your photos solely for the purpose of generating style transformations. We do not intentionally retain your original photos beyond real-time processing.
You represent and warrant that: you are the owner of or have obtained all necessary rights and permissions for any photo you upload; you have obtained the consent of any individual depicted in photos you upload; if you upload a photo containing a minor, you must be the parent or legal guardian of that minor, or have obtained explicit consent from their parent or legal guardian; you acknowledge that enhanced safety processing will be automatically applied to such photos; you will not attempt to use the App to generate sexual, nude, exploitative, or otherwise harmful content involving minors; and you will not upload explicit, nude, or sexually suggestive photos.
You assume full legal responsibility for uploading photos of minors. We do not independently verify the age of individuals in uploaded photos or the uploader's relationship to any minor depicted. Uploading photos of minors carries additional legal responsibilities under applicable child protection laws. You must ensure full compliance with all relevant laws in your jurisdiction.
You own the transformation results generated from your photos, subject to these Terms. You may use, save, share, and distribute your transformation results for personal and non-commercial purposes, including posting on social media platforms. The transformed images are generated by AI and are derivative works based on art historical styles that are in the public domain. You may store results in your device's local gallery within the App.
You are solely responsible for the storage, sharing, and distribution of your transformation results. If a transformation result contains artistic nudity, you are prohibited from sharing or distributing such content to minors. Violation of this provision may result in immediate account termination.
You agree not to use the App to: use photos of minors to generate sexual, nude, exploitative, or otherwise harmful content; attempt to circumvent, bypass, or weaken the App's minor protection safeguards through adversarial prompts, style combinations, repeated uploads, or any other means—such attempts may result in immediate account termination; upload photos of other individuals without their explicit consent; create non-consensual intimate, nude, or sexually explicit imagery of any person; create deepfake content or content intended to deceive others about the identity of the subject; create, distribute, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; attempt to circumvent, disable, or interfere with any content safety or moderation features of the App; attempt to reverse-engineer, decompile, or disassemble any part of the App; use the App for any commercial purpose without prior written consent; or use transformation results in any manner that could be construed as an endorsement, recommendation, or testimonial by the individual depicted. You are solely responsible for any commercial or malicious use of the transformation results.
We reserve the right to refuse to process any photo that violates these Terms or that our content moderation systems flag as inappropriate. We may refuse to generate or deliver any output if our safety systems determine a risk. Generated outputs may be subject to third-party safety filters; outputs identified as inappropriate may be blocked or not delivered. We employ a multi-layer content safety system—including prompt engineering restrictions, content restriction, and refusal mechanisms for prohibited categories—but we do not guarantee that all inappropriate content will be detected or prevented. We may terminate or suspend your account without notice if we determine, in our sole discretion, that you have violated these Terms.
The App, including its design, code, educational content, AI models, and all associated intellectual property, is owned by Master Valley. All art historical references, masterwork compositions, and educational descriptions are used for transformative and educational purposes. The App's technology for automatic artwork selection is protected by existing patents.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF ANY AI-GENERATED CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MASTER VALLEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM AI-GENERATED CONTENT, UNINTENDED OR OFFENSIVE TRANSFORMATION RESULTS, LOSS OF DATA, OR SERVICE INTERRUPTIONS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Master Valley, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: your use of the App; your violation of these Terms; your violation of any rights of a third party, including intellectual property, privacy, or publicity rights; any photos you upload to the App; or any transformation results you share or distribute.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved through binding individual arbitration, rather than in court, except that either party may seek equitable relief in court for intellectual property infringement or unauthorized access to the App. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Master Valley. The arbitration shall be conducted in accordance with the rules of the Korean Commercial Arbitration Board (KCAB), and the language of arbitration shall be English. This arbitration provision shall survive termination of these Terms.
We reserve the right to modify these Terms at any time. Changes will be effective upon posting within the App or on our website. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
We reserve the right to suspend, modify, or discontinue the App, in whole or in part, at any time without prior notice or liability. In the event of permanent discontinuation, we will make reasonable efforts to provide advance notice. Unused cash is non-refundable upon service termination, except as required by applicable law. Additionally, accounts that have been inactive for an extended period (e.g., one year or more) may be subject to dormant account processing, separate storage, or deletion of personal information after prior notice.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
